CLARIFICATION TEXT FOR CANDIDATE EMPLOYEES
ABOUT PROCESSING OF PERSONAL DATA
Dear Candidate Employee;
This clarification text has been prepared by Bc Fiber Optik San. Ve Tic. A.Ş., which acts as data controller, in order to inform you about within the scope of the Communiqué on the Procedures and Principles to be Followed in Fulfilling the Obligation of Disclosure with Article 10 of the Law on the Protection of Personal Data No.6698 ("LPPD") about the purposes of processing your personal data, legal reasons, collection method, to whom they can be transferred and your rights under the LPPD.
We do not have absolute control over the information you provide on your CV's you send to us or on the websites that allow you to reach us. We recommend that you do not share your personal data and sensitive personal data that you do not want us to know with our Company.
1-Which Personal Data Do We Process?
✓ Your name, surname, date and place of birth, gender, marital status, nationality;
✓ Your e-mail address, address, mobile phone number;
✓ If you include it in your CV, your health information (such as your disability information);
✓ Your educational status, certificate and diploma information, expertise, foreign language, information about your skills, information about seminar and courses you attended, your computer knowledge, your exam result information;
✓ Information about your work experience (for example, previous sectors, companies, positions, responsibilities, salary);
✓ Your photo;
✓ Your driver's license information;
✓ Information about your hobbies;
✓ Your salary expectation;
✓ Your military status information,
✓ Your reference information (reference person's name, surname, title, workplace, contact information),
✓ Other information that you include in your CV voluntarily but that we cannot foresee
✓ Are processed in accordance with the LPPD.
Your data in question can be kept with Bc Fiber Optik San. Ve Tic. A.Ş. for up to 1 year if your job application is not approved, and up to 10 years after you leave the workplace if approved.
2-For What Purposes We Process Your Personal Data?
Your abovementioned personal data are processed for the following purposes for the performance of this Service Agreement regarding the employment service we provide to you:
✓ Managing your job application process,
✓ Communicating with you,
✓ Determining whether you have sufficient equipment for the position we will recommend to you,
✓ Meeting with people we can take reference about you and determining whether you are suitable for the job,
✓ Determining the position information you want to work for, your salary expectation, whether you can work in other positions and your starting date,
✓ Determining that you can use the vehicle when it will be required for you to use company vehicles,
✓ Determining your age status for the position to be proposed to you and complying with the Regulation on the Procedures and Principles of Employing Child and Young Workers,
✓ Remembering you easily by our human resources department when you come to the interview,
✓ Contacting the candidate employee and preparing the personnel file if the candidate employee is accepted to the job,
✓ Determining whether you have a condition that may interrupt your work during the employment contract's term and compliance with Article 75 of the Military Penal Code No. 1632.
3-By Which Method And On What Legal Grounds Do We Process Your Personal Data?
The personal data in question are processed automatically (for example, automatically sent to our system on the internet) or non-automatic ways (for example, if we note an information you have given us on the phone) based on the legal reasons of (i) “it is mandatory for the data controller to fulfill his/her legal obligations”, (ii) “provided that it does not harm the fundamental rights and freedoms of the relevant person, it is an obligation to process data for legitimate interests of the data controller” and (iii) “ provided that it is directly related to drawing up or performing a contract, it is required to process personal data of the parties of the contract” in Article 5 of the Law, depending on your explicit consent.
4-To Whom and For What Purposes Do We Transfer Your Personal Data?
Your personal data may be transferred to the judicial authorities or the relevant law enforcement authorities upon request to resolve legal disputes or in accordance with the relevant legislation.
5-What Are Your Rights Regarding the Processing of Personal Data and How Can You Access These Rights?
You can send your requests regarding your rights stated in Article 11 of the LPPD to Bc Fiber in writing according to Article 5 "Communiqué on the Procedures and Principles of Application to Data Controller" or to the registered e-mail address (KEP), by using secure electronic signature, mobile signature or the e-mail address previously notified to the data controller by the data controller and registered in the data controller's system. An application form that you can use has been provided on our website in order to inform you and provide you convenience.
